Most often, the matter begins with a specific document: a summons has been served, a military medical commission has been scheduled, the command has signed a discharge order, or a payment has not been approved. Less often, people come in advance — before signing a contract, or when they need to check how service length has been counted. In both cases the question is the same: what does this mean in law, and what steps should be taken next.
The article explains how a military lawyer reads a summons and a commission's conclusion, which arguments work for deferral and exemption, what is checked before a contract, and how a discharge dispute is built. The initial assessment begins with the documents at hand: the registration certificate, the decision of the conscription commission, summonses, medical conclusions, certificates of study, work and family status. From these, the stage of the case and the stated grounds for deferral or exemption are clear.
Separately, circumstances that are not fully reflected in the papers are clarified: health and complaints, family composition, study, children, care for a relative. Conscription is administered by the local defence administration, so it is important to understand which decision was taken and whether it was served.
Before applying, the dates are recorded: service of the summons, adoption of the decision, the moment when the violation became known. The appeal time limits run from these. A review of the documents shows where a procedural step was missed and what can still be corrected.
A military lawyer checks whether the decision of the defence administration complies with the legislation of the Republic of Kazakhstan and whether the medical and social grounds were examined in full. At the initial stage, copies and explanations are sufficient.
A call-up notice is served on the conscript in person against signature, or at the place of residence or work through authorised persons. Service on parents, neighbours or by post without confirmation of receipt is not always considered proper notification, and it is on this that the position in a challenge is built. The type of notice determines the scope of duties: updating data, a medical commission, a sitting of the conscription commission or dispatch to the place of service. If a call-up notice has arrived, what to do depends on the stated purpose and the stage of conscription.
A conscript has the right to review the materials of his personal file, to undergo a medical examination, to state disagreement with the conclusion on fitness and to appeal the decisions of the conscription commission. Fitness is determined by the military medical commission; its conclusion is appealed in writing and through the court. Refusal to accept a call-up notice does not invalidate the notification if service is confirmed by witnesses and a report is drawn up. Conversely, an attempt not to sign a call-up notice without explaining the reasons is recorded as evasion and creates a risk of liability.
The fitness category is determined by the results of a medical examination by the military medical commission. The decision is taken according to the schedule of diseases, taking into account the actual state of health of the conscript or serviceman. The conclusion is recorded in the records and affects assignment to types of service, the possibility of discharge or leave on health grounds. An error in the diagnosis or incomplete documents lead to an unfounded decision, which can be challenged.
Medical documents confirming the diagnosis are of key importance: extracts, results of instrumental and laboratory tests, conclusions of relevant specialists, certificates of past illnesses and injuries. The records must be legible, duly certified and contain complete information about the treatment. If a medical organisation refuses to issue documents or enters incomplete data, this complicates assessment of the state of health. A military lawyer for the military medical commission helps to build the evidence base and to check whether all documents have been added to the personal file.
The grounds for deferral and exemption from conscription are divided into family, educational, medical and service grounds. A military lawyer assesses them not on the basis of oral explanations, but on the basis of documents confirming the conscript's right at the time the commission sits. Family grounds take into account care for a close relative, minor children, and the status of sole breadwinner. An educational deferral is connected with study at educational organisations holding a licence and accreditation. It is confirmed by a certificate from the educational institution, the study contract and documents on completion of the educational programme. Service grounds concern work in state bodies and special formations where length of service and seniority are required.
Medical grounds require a conclusion of a medical commission and the results of an examination, which are added to the conscript's personal file. Exemption on health grounds does not come down to a diagnosis: the fitness category under the schedule of diseases is what matters. A challenge to the decision of the commission is built on an additional examination and the conclusion of an independent specialist.
The format of a military lawyer's involvement depends on the stage and the level of conflict in the situation. A one-off consultation closes a narrow question — the procedure for a deferral or the deadlines for appealing a conclusion: the specialist reviews the provisions of the Law of the Republic of Kazakhstan "On Military Service and the Status of Servicemen" and sets out the steps. If there is a summons, a medical board conclusion or a decision of a local military administration body, a review of documents is needed: it reveals procedural violations and the basis for objections.
Where there is an obvious violation confirmed by documents, preparing a complaint to a higher body or a court is sufficient. In a protracted dispute involving the collection of evidence, several hearings and interaction with administrative bodies, it is more sensible to have the case handled end to end.
Conscription and deferrals are handled by the department for defence affairs, so correspondence and appeals are conducted through that body. The workload depends on the number of instances, the medical examination and the volume of documents. In military cases the outcome is more often decided not by emotion but by a document: a properly executed commission conclusion, an archival certificate or a written application with a registration mark.
Before signing a contract for military service, a military lawyer checks its content for compliance with the Law of the Republic of Kazakhstan "On Military Service and the Status of Servicemen". The text must expressly state the voluntary nature of the expression of will, the term of service, the position and the military unit. The terms of the contract are analysed separately: the procedure for appointment to a position and transfer, types of allowance, and the grounds and procedure for amendment or termination. Without this information the document is not considered complete and creates a risk of challenge.
Fitness for service is determined by the military medical commission; its conclusion is challenged in writing and through the court. Therefore, before signing, the lawyer compares the commission's findings with the requirements for the specific position and checks whether there are any contraindications that the candidate has not disclosed. If the conclusion is being challenged, signing the contract before the dispute is resolved is not advisable. This also affects the subsequent termination of the contract on health grounds.
The dismissal of a service member affects status and social guarantees, so the command must observe the grounds and procedure under the legislation of the Republic of Kazakhstan on military service. The submission is prepared on a specific ground: expiry of the contract term, state of health, organisational and staffing measures, a disciplinary offence, or the age limit. The ground is confirmed by documents, and the decision is formalised by an order of the authorised body.
Typical violations: incomplete review of the personal file, absence of a military medical commission conclusion, failure to observe the attestation and interview procedure, distortion of the wording of the ground. It is precisely these procedural defects that most often lead to the order being set aside. Disputes with the command, including over dismissal, are considered under the Administrative Procedural Code of the Republic of Kazakhstan in administrative court proceedings.
On challenge, the lawfulness of the ground and the procedure for its application are reviewed: whether the wording of the order corresponds to the actual circumstances, whether the service member's rights were observed, and whether mitigating circumstances and the conclusion of the military medical commission were taken into account. If a violation is confirmed, the question of reinstatement in service or of changing the ground of dismissal to a more favourable one is raised.
A service member's length of service is made up of periods of military service, service in special state and law enforcement bodies, and other periods provided for by the legislation of the Republic of Kazakhstan. It includes time in military positions, study at military educational institutions, time at the disposal of a commander within the established period, and leave without pay in the stipulated cases. Certain periods are counted on a preferential basis: service in remote areas, and in conditions equated to combat. The list and the rules of calculation are determined by the Law of the Republic of Kazakhstan "On Military Service and the Status of Service Members" and subordinate acts.
Pay includes the position salary, the salary by military rank, allowances for special conditions of service, length of service, class rating and other payments, as well as regional coefficients for remote regions. Allowances are calculated from the salaries and depend on confirmed length of service: an error in the calculation reduces the payments. Deductions are permitted only on the grounds established by law and cannot exceed the established limits. Verification of the calculation begins with reconciling the orders, the pay slips and the personal file.
Housing provision for service members in Kazakhstan means being placed on the waiting list for those in need of housing from the state housing fund, or housing payments. The grounds, the accounting norm of area and the list of documents are determined by housing legislation and departmental acts; the decision is taken by the local executive body or the housing commission at the place of service. Conscription and deferrals are handled by the department of defence affairs, while housing matters are resolved separately. A military lawyer handles housing matters from the collection of certificates to challenging a refusal to be placed on the waiting list.
Recognition as being in need of housing requires confirmation of status, family composition, and the absence or insufficiency of housing owned or held under a lease. Family members living together are taken into account, as well as housing previously received from the state or disposed of. Errors in certificates of registration, income and family relationships are a frequent reason for documents being returned. Disputed situations arise from a refusal to take a spouse or children into account, from removal from the waiting list after a move, and from a change in the accounting norm.
Challenging decisions of a military unit begins with establishing which particular act violates the rights of a conscript or service member: a decision of the conscription commission, a conclusion of the military medical commission on the category of fitness, an order of a commander imposing a disciplinary sanction, or a refusal to pay. Fitness for service is determined by the military medical commission; its conclusion is challenged in writing and through the court. Before applying to court, a military lawyer builds the pre-trial procedure: it allows the violation to be remedied without a lengthy process and records the applicant's position.
A complaint to a higher body is filed through the chain of subordination: against a decision of a district conscription commission — to the higher conscription commission of the region; against the actions of a unit commander — to a higher commander or to a military administration body. The complaint is drawn up in writing, stating the details of the act being challenged, the grounds for disagreement and the applicant's demands. Copies of documents confirming the violation are attached to the complaint, and the complaint itself is registered with an incoming number, which records the date on which the consideration period begins to run.
Collecting supporting evidence begins before the first consultation: it determines which claims can realistically be made. The documents are needed to compare entries in the records, medical reports and orders. Without them the position is built on assumptions, while the time limits for appeal keep running. Under the Administrative Procedural Code of the Republic of Kazakhstan, disputes between servicemen and the command, and those concerning discharge, are considered in administrative court proceedings, where proof rests on written evidence.

A procedural time limit is the period during which an application or complaint in a military case is filed with an authorised body or court. For challenging decisions of the conscription commission, conclusions of the military medical commission, and actions of officials of the local military administration body, the time limits are tight, and the calculation begins from the moment the person became aware of the violation of their right. A lawyer checks the time limits first: the very possibility of protection depends on this — a well-founded claim filed late is left without consideration on the merits.
A missed time limit is not a refusal of protection, but an obstacle that can be removed by a separate motion. An application to restore the time limit is filed together with the complaint, and it states the reasons why the person could not apply on time. The law links restoration to valid circumstances, not to subjective disagreement with the decision.
