Home visit to an elderly client

An 84-year-old woman could not come to the office, and the inheritance deadlines were tight

Situation
The client had a fracture and could not leave the house. Three weeks remained until the deadline for accepting the inheritance, the documents were at home in different folders, and the relatives who could have helped were an interested party in the same inheritance.
What we did
We came to her home, sorted through the documents on the spot, drew up a list of what was missing and arranged a power of attorney with a notary visiting the home. After that we collected the certificates and filed the documents ourselves, coming to the client only for signatures.
Outcome
The inheritance was accepted within the deadline. The client's share in the flat was registered, and the relatives' attempt to take the inheritance behind her back failed.
Visit to the property

A dispute over the quality of repairs was dealt with right in the flat

Situation
The client was in a dispute with a construction crew over the quality of the renovation: the contractor claimed everything had been done according to the estimate, while the client saw crooked walls and ventilation that did not work. It was impossible to make sense of it from the photos in the messages — each side saw what it wanted to see.
What we did
We went to the site together with an independent specialist, inspected the premises, checked the work done against the estimate and drew up a defect report linked to each room, with photographic evidence for every item. We also spoke with the contractor's representative on the spot.
Outcome
The contractor acknowledged most of the defects and fixed them at his own expense. The remaining cost of the work was recalculated, and the dispute was settled without going to court.
Site visit for signing

The deal was about to fall through because of the health of one of the parties

Situation
The seller of the flat was hospitalised two days before the deal. The buyer had already received the bank's approval, which was about to expire, and the deal could have collapsed with all the consequences for the deposit.
What we did
We agreed with both parties and the bank on a visit to the seller: we arranged for a notary to be present, checked his condition and his ability to understand the meaning of his actions, and documented this so that the deal could not later be challenged.
Outcome
The deal was completed on time, and the bank's approval did not lapse. There were no attempts to challenge it six months later — the documented record of the circumstances removed that risk.
Visit to hospital

The documents were signed in the hospital ward: the client could not come to the office

Situation
The man was in hospital after surgery, and the deadline for filing objections in a court case was due to expire in four days. He had not had time to arrange a power of attorney, the documents were at his relatives' home, and he could not move around.
What we did
We agreed with his attending doctor on a visit, went to the hospital with a draft power of attorney and a notary, who certified it in the ward. At the same time we took the documents from his relatives and prepared the objections that same evening.
Outcome
The objections were filed on time, and the case was heard with a representative taking part. The claims against the client were reduced by 1,700,000 tenge — had the deadline been missed, there would have been nothing left to argue about.
Elderly client

Neighbours suggested an elderly woman 'arrange care' in exchange for her flat

Situation
Acquaintances approached the pensioner, who lives alone, with a proposal to conclude an agreement: they would care for her, and the flat would pass to them after her death. They brought the document ready-made, hurried her to sign and offered their own notary. The relatives found out about it by chance.
What we did
We went to the client's home to sort things out without haste and in surroundings she was used to. We went through the proposed text: it was a gift agreement with a condition precedent, and it effectively created no care obligations at all. We explained the difference between a gift, a will and a life maintenance agreement.
Outcome
The client chose a will that she could change and a separate care agreement with specific obligations and payment. The flat remained her property, and she receives assistance under an agreement that can be terminated.
Inspection of the property

The lawyer saw things at the property that were not in the documents

Situation
The client was buying a private house, and the documents for it were in order: the title was registered, there were no encumbrances, and the technical passport was up to date. The deal was planned remotely, without an inspection by a lawyer — the buyer had viewed the house himself and was happy with it.
What we did
We insisted on a visit and inspected the plot with the documents in hand. We found that the summer kitchen and garage were not listed in the technical passport, the actual fence was shifted a metre and a half towards the neighbour, and a protected utility zone ran across the plot, restricting construction.
Outcome
The price was reduced by 4,100,000 tenge to account for the cost of legalising the buildings and moving the boundaries. The dispute with the neighbour was resolved before the deal by a boundary agreement — the buyer got a house without someone else's problems.
Visit for the deal

At the signing it turned out that the seller was acting under an outdated power of attorney

Situation
The parties met to complete a flat sale at the agency's office. The seller's representative produced a power of attorney drawn up more than a year earlier and hurried the signing, citing the fact that the owner was away and everything had been agreed.
What we did
On the spot we checked the power of attorney against the register, its validity period and the scope of authority: the right to receive money was not specified in it. We contacted the owner, confirmed his wishes and agreed on a payment procedure directly to his account.
Outcome
The deal was completed the same day, but with a changed payment procedure. The money reached the owner, and the representative received only a fee under a separate document.
A family meeting

The inheritance was divided in the kitchen, not in court

Situation
After their father's death, four heirs could not agree on how to divide the estate: a flat, a country house and a car. Every conversation ended in a quarrel, and two of them were already preparing to file claims. Getting everyone together at the office was not possible — two were caring for their mother and could not leave for long.
What we did
We travelled to the family's home and held a meeting with everyone at once, with the documents and a valuation of the property in hand. We worked through the options: division in kind, buyout of shares, sale with distribution of the money. We drafted an agreement directly at the meeting, with compensation calculations.
Outcome
The division agreement was signed before a notary a week later, and no court claims followed. The family preserved their relationship, and the paperwork took a month instead of a year of litigation.

Useful information

A lawyer who visits your home in Almaty: when a meeting at home is appropriate

Situations vary: an elderly parent finds it hard to get to the office, someone has limited mobility after surgery, and someone else's work schedule leaves no time for travelling around the city. In such cases, a lawyer visiting the home saves energy and time, but only if the meeting is prepared for in advance.

There is usually one mistake: a meeting is arranged without gathering the documents, without formulating the question and without discussing on the phone what exactly needs to be resolved. As a result, the specialist arrives and the conversation turns into a retelling of family history instead of work with the papers. It is even worse when documents are signed at the meeting without checking their content — correcting what has been signed afterwards is harder.

A lawyer who visits your home in Almaty: when a meeting at home is appropriate

A lawyer visiting your home in Almaty is a normal way of working, not an exception. It is convenient when a person finds it difficult to get to the office: because of age, limited mobility or a busy schedule. A meeting at home saves time and allows the situation to be worked through in familiar surroundings, without haste.

At home it is convenient to lay out the papers, go through each point calmly and not stretch the conversation out over the whole day. It is worth inviting a specialist separately to inspect a property or sign documents when travelling yourself is risky and time-consuming.

This format is particularly useful in several cases:

  • Elderly clients and clients with limited mobility who find it hard to get around the city.
  • A large volume of documents that is inconvenient to bring to the office.
  • The need to inspect a property on site.
  • Family meetings where it is important to discuss shared matters.
  • Signing documents without travel and queues.

An elderly parent needs a lawyer who visits the home: how to organise the meeting

Before the meeting, clear unnecessary papers off the table and leave only the documents relevant to the matter: contracts, receipts, correspondence, ID. Explain to your elderly parent in advance that the lawyer is coming to talk and help, not to scold them or take the documents away. Say that the conversation will take place at home, in familiar surroundings, and that they will be able to ask any questions.

On the day of the meeting, turn off the television, remove loud music, and put water and glasses nearby. If it is difficult for the parent to speak, prepare a short note with the main question. One of the close relatives may be present, but should not interrupt or answer on their behalf — this way the lawyer will understand the situation more accurately.

  • Write down the questions in advance and keep the sheet at hand.
  • Prepare the passport and case documents in one folder.
  • Welcome the lawyer and show them into a room where it is comfortable to sit.
  • Warn them if the parent needs a break or quiet.
  • Do not argue in front of the parent about money and inheritance.

Calling a lawyer to your home: how the phone conversation goes before the meeting

Before the meeting, the lawyer will certainly clarify a few things by phone so as to arrive prepared rather than work things out on the spot blindly. Say what the visit is needed for: inheritance, a flat transaction, a land dispute, a debt or a family matter. State which documents you already have and what you want to achieve as a result of the meeting.

The phone dialogue before the visit costs nothing. It is not a formality: within a few minutes of conversation it becomes clear whether a home visit is appropriate or the matter can be resolved differently, which papers to prepare and how long the appointment will take. Write down your questions in advance so as not to forget anything during the conversation and at the meeting.

If it turns out by phone that some documents are with you or a relative, the lawyer will advise what to prepare for the visit and what can be restored later. To call a lawyer to your home, it is enough to describe the situation briefly in your own words.

How many documents to prepare for a lawyer's visit to your home

When a lawyer comes to your home, it is better not to spend the meeting time searching for papers. Gather in advance what relates to the case and arrange it in folders or at least in piles: this way the specialist on the spot will see the whole picture and deal with your specific situation rather than general rules.

First of all, identity documents and papers for real estate or vehicles are needed. If the dispute concerns relatives — marriage, birth and death certificates, and the will. Bring correspondence, receipts, acknowledgements and court notices even in drafts and messenger chats. When there are many documents and they are scattered, write a short chronology of events in advance: this will speed up the review.

  • Identity document, and for a representative — a power of attorney
  • Title documents for the flat, house, land or car
  • Contracts, receipts, payment slips, cheques, bank statements
  • Marriage, birth and death certificates, the will
  • Correspondence, court notices, summonses, rulings

A lawyer visiting your home examines the documents: what can realistically be resolved on the spot

During a home visit, the lawyer provides a consultation, reviews the papers brought and prepares drafts: an application, complaint, pre-action claim, statement of claim, motion, contract or power of attorney. They can check the title documents for a flat or land plot, review a sale and purchase or loan agreement, verify calculations for utility and other payments, and assess the prospects of an inheritance or property division dispute. Consultations, work with documents and preparation of drafts — these are the limits of the specialist's competence at your home.

Certifying documents on the spot is not within their powers: that is done by a notary. If your matter requires a notarial form — for example, certification of a will, consent or power of attorney, as well as certification of the accuracy of a copy — the lawyer on the visit will study the documents, explain the procedure and prepare the necessary draft, and a notary will certify it.

  • Consultation and review of the situation
  • Work with documents and verification of data
  • Preparation of drafts of applications, statements of claim, contracts

Comparison of formats: office, online or a lawyer visiting your home

The choice of format depends on the client's mobility, the volume of documents and the type of task. If a person has difficulty getting around or is busy and cannot come to the office, a home visit resolves the matter without travelling across the city. But when there are many documents and in-depth work is needed, the office or online format gives more time and a calm environment.

Below is a comparison of the key parameters to help you choose the right option:

  • Limited mobility: a lawyer's home visit is suitable if travelling to the office is difficult.
  • Volume of documents: up to 20–30 pages is convenient at home, more is better at the office.
  • Consultation: online is suitable for quick questions without an inspection.
  • Transaction: a home visit is appropriate if the signing takes place on site.
Comparison of formats for meeting a lawyer
Criterion Office Online Home visit
Client's mobility Need to travel Any Without leaving home
Volume of documents Any Up to 20–30 pages Up to 20–30 pages
Type of task Complex cases Consultations Inspection, signing

If there are more documents, some can be handed over at the office or discussed online.

A lawyer attending a transaction on site: what to check before signing documents

A lawyer attending a transaction on site starts by reviewing the title documents: the sale and purchase agreement, gift agreement or other basis, the technical passport, and the certificate of registered rights and encumbrances. The lawyer checks the owner's details against the identity document, and verifies whether there are any arrests, pledges, powers of attorney, and third parties whose consent is required. If the seller or buyer is an elderly person, a separate assessment is made of whether the person understands the meaning of what they are signing and is not acting under someone else's influence.

In the draft agreement, it is important to check the payment procedure, the moment the right passes, the composition of the property being transferred, and the liability of the parties. A flat or house must not be re-registered under pressure: if you are being rushed, not allowed to read, told it is the "last day", or pushed to sign without checks, that is a reason to stop. "Lawyers" who turn up uninvited and offer elderly people an urgent re-registration of their home should raise alarm. Before signing, make sure all the terms are clear and that the money is handed over in the agreed manner.

  • Title document and certificate of rights
  • Technical passport and identity document
  • Consents of the spouse and other interested parties
  • Draft agreement with the payment and handover procedure

Inspecting the property and signing documents: what a lawyer attending on site does

When the meeting concerns a flat, house, commercial premises or other property, the lawyer first inspects the property. Items may also be the subject of inspection: a car, equipment, machinery, jewellery, if they are being sold, pledged or included in the estate. The point is simple: signing documents for a property you have not seen is risky.

During the inspection, the lawyer checks whether the actual condition and layout match what is stated in the title documents and the technical passport, and records visible defects and signs of redevelopment. The condition of the property is then put in writing: in an inspection report or an annex to the agreement. It is useful to attach photo and video records straight away, and to state in the text the date and time of the inspection and who took part in it.

  • What exactly is inspected and in what condition
  • Discrepancies with the documents and technical passport
  • Visible defects and signs of redevelopment
  • Photo and video records, inspection report

A family meeting with a lawyer attending on site: how to negotiate without arguments

When several relatives discuss property and inheritance matters, the conversation easily turns into an argument about past grievances. A lawyer attending on site takes the role of facilitator: sets out the topics, keeps to the order, and does not let the discussion slide into personal accusations.

At such a meeting, those present calmly work through who owns what, how the real estate in Almaty is registered, and what debts and obligations each person has. The lawyer asks clarifying questions, records what is said, and explains which documents will be needed next.

  • Set out the purpose of the meeting: division of property, registration of inheritance or guardianship.
  • Agree a time when things are calm at home and no one is in a hurry.
  • Prepare the title documents and account statements.
  • Agree not to bring up old grievances and not to interrupt each other.

Timing of the meeting: a lawyer attending on site will arrive the next day

If a request is submitted today, a lawyer will come to the home the next day. This is convenient when a meeting is arranged for an elderly relative: there is time to warn them, help gather the documents and free up the morning. The exact time is agreed by phone, taking into account the address in Almaty and the workload of home visits.

The consultation itself usually takes an hour. During this time the specialist studies the documents, asks questions and explains what can be resolved on the spot and what will require further steps. An elderly person is more comfortable when the conversation takes place in familiar surroundings and without haste. If a relative is taking part in the meeting, it is better to arrive at the start so that the details can be discussed together.

To plan the day, use this as a guide: it is better to schedule the visit after breakfast and medication, and not to arrange other matters straight after the meeting. If the elderly person needs to rest, the discussion can be paused and continued later.

The contract with the lawyer before work begins: what is signed during a home visit

The contract for legal services is signed before the specialist starts work. If, at the meeting, you are offered to discuss the matter first and formalise the papers later, that is a reason to be wary: the scope of the engagement and liability must be fixed in advance. Read the subject of the contract carefully — exactly what actions are entrusted to the provider.

Check that the contract states the parties, their details and the date. Refuse terms that give the provider the right to change the scope of work without agreement, as well as vague wording such as "other services as necessary". Clauses on deposits and non-refundable payments are dangerous — it is better not to sign them.

  • Subject of the contract: specific actions of the lawyer, not a general wording
  • Rights and obligations of the parties: who provides what and within what timeframes
  • Procedure for amending the terms: only by written consent
  • Liability of the parties: what the provider and the client are responsible for
  • Termination terms: how the services can be declined

What happens after a meeting with a lawyer during a home visit in Almaty

After the meeting, the lawyer builds a working picture from the documents and prepares a plan of action: what is done by application, what requires a contract, and what requires an appeal to a state body or a court. If some matters are resolved on the spot, the result is recorded in writing, and copies of the papers remain with the client.

A separate area is support when visiting a notary: the lawyer helps gather the package, checks the wording before signing and is present at certification, so that the elderly person does not have to navigate the procedure alone. From there, support follows the agreed plan: the lawyer keeps in touch, reports on the progress of the matter and agrees each next step.

  • Preparation and submission of documents to the agreed authorities
  • Monitoring of deadlines and requests from state bodies
  • Supporting the client at the notary and at signing
  • Informing about the result and further actions

Mistakes when calling a lawyer to the home: what the elderly in Almaty should look out for

A common risk is a visit from a "lawyer" without an appointment. A genuine specialist does not arrive without an arrangement, does not rush you with papers, and gives their name, status and practice. If they insist on payment or a power of attorney — close the door.

An honest lawyer first clarifies the essence of the matter and asks for the documents, and only then talks about a meeting. If the visitor is confused, take a pause and consult your relatives. Below is a short check before letting someone in.

  • Ask for the full name and status: advocate, lawyer or notary
  • Ask to show an ID or a business card with details
  • Clarify who exactly sent them and on what matter
  • Do not sign papers and do not pay until you have taken advice
How to check a lawyer who makes house calls
Sign A genuine lawyer A suspicious visitor
Arrival Comes after a call and an appointment Knocks without warning, pushes for a meeting
Documents Shows an ID, states their practice Avoids the question, does not state their status
Conversation Asks questions, requests documents Rushes you, promises a quick result
Signing Leaves you time to decide Insists you sign and pay straight away

If you have doubts, postpone the visit and call back the organisation whose name the visitor gave.

A house call is not simply an office consultation moved into your flat: documents still play the main role, and without them the meeting turns into a general conversation. Prepare the papers in advance, and put off signing any documents until the lawyer has read them.

I'm 78, walking is hard for me. They came to my home and went through all the papers for my husband's inheritance. Calmly, without rushing, they explained things three times where I didn't understand.

My mother was in hospital after an operation, and I needed to arrange a power of attorney to deal with her flat. I couldn't get away from work myself, so I started looking for a lawyer who does home visits. I called, explained the situation, they only asked for the address and a convenient time. The lawyer came right to the ward, calmly explained everything to my mother, and she signed. I was afraid I'd have to take her to a notary, but it was all done on the spot. It took, I think, less than an hour. Mum said afterwards that they talked to her like a human being, didn't rush her. I was pleased that I didn't have to redo anything or make a second trip.

I needed to sort out the documents for a plot of land, and after my operation I couldn't walk well. The price for the visit was quoted in advance and didn't change. A small thing, but nice, usually you always end up paying something extra

A neighbour started parking his car right under my windows and blocked the way to the entrance. I first called to find out what to do. On the phone they said no visit was needed and the matter could be resolved through the PSC, they explained which papers to collect. I was glad I wouldn't have to spend money, and went off to sort it out. But then the neighbour started arguing, claiming it was his spot, and the conversation reached a dead end. So I called again, and they did come once a dispute with the neighbours arose. The lawyer drafted an application and explained where to take it. In the end the matter moved forward, the neighbour moved his car. Good that they didn't push a visit on me at first, and then still helped anyway.

I'm 78, walking is hard for me, and the matter concerned a flat I wanted to sign over to my granddaughter. I wouldn't have made it to the office myself, so I looked for a lawyer who would come to my home. They came, sat down at the table with me, and went through my whole archive of documents. I no longer remembered what was in there, it had piled up over the years. They found a paper I'd forgotten about, and it settled everything. It turned out it was the very thing confirming my right, without it nothing would have worked. Everything was explained to me calmly, I understood what and why. My granddaughter said afterwards that it was all done properly. Thank you for not making me travel across the whole city.

We came to my mom, she's bedridden, can't do anything herself. We needed a power of attorney. Sanzhar explained everything, brought the papers with him. We got the power of attorney done, then everything was done without her. Very convenient that we didn't have to bring my mom. Thank you.

Very attentive, didn't rush me, explained things twice when I didn't understand. The only thing is I waited almost a day for a reply to my message, but then everything was caught up quickly. Overall I was satisfied.

I was selling a flat, the buyer brought his own contract, and I wasn't sure whether to sign straight away. I'd never dealt with contracts before, I was afraid of missing something important. We called a lawyer to the flat transaction. He read the contract right in the buyer's office, two clauses were changed. He also advised which certificates were better to get before signing. The only thing is I had to wait about twenty minutes for him, traffic in the centre. But it didn't affect the outcome. The deal went through calmly, I didn't sign anything blindly. The buyer grumbled, but accepted the terms. I'm glad I wasn't left alone with those papers

We gathered the whole family at home to sort out the inheritance. Gulnara came to us and laid it all out clearly. It turned out easier than everyone going to the office.

I had a problem with the documents for the house, I didn't know where to start. I'm old, it's hard to go to the office. Thanks for not charging extra for the visit. The price was like a regular consultation. They explained everything, left me a list of papers.

The neighbour moved the fence and took over part of my plot, I was collecting papers but couldn't prove anything. I needed the house inspected for the dispute with the neighbour, and Viktor came and recorded everything. They came, took photos, took measurements

The house is registered in my father's name, the papers were all over the place, I didn't know which ones to take where. So I looked for a lawyer. The person who came looked through everything and said my question could be sorted out without a lawyer. Explained which office to go to and which document to get. I didn't waste money, I sorted everything out myself.

They came to see my father, he had a stroke and couldn't speak himself. Sanzhar treated him calmly, understood everything without unnecessary words. They treated us like human beings, not just a client.

Our plot is far outside the city, a dispute with the neighbour over the boundary. I was afraid no one would come because of the distance. They came out to the district, far from the centre. They didn't refuse and didn't ask for extra payment for the distance

The papers left from my father had piled up in a chest, I couldn't tell which ones were needed and which weren't. So I looked for a lawyer who comes to your home, I didn't want to be out on the street, my children are small. Gulnara came, understood straight away, sat down without rushing and looked through everything. We opened the old chest and sorted the papers one by one, putting what was needed separately from what wasn't. We threw some papers out, kept some, she told me which ones were important. Thank you, she's a very thorough person

FAQ

How much does a home visit cost?

The indicative price of a visit within the city is listed in the price section above; evenings and weekends cost more. The amount is agreed before the visit and does not change afterwards. The consultation and review of documents on site are included in this price and are not charged separately.

And is the consultation free when you come out?

No. Only the preliminary conversation by phone is free, where we establish the essence of the matter and whether a visit is needed at all. The visit itself is paid, but its price already includes the consultation.

How quickly can a lawyer be called out?

Usually the next day, and in urgent cases — the same day. Night-time and emergency situations are handled by a duty lawyer around the clock.

Do you visit hospitals?

Yes, if the institution's rules allow it. Such visits are most often connected with powers of attorney and the preparation of documents.

What should I prepare for the meeting?

All documents relating to the matter, even those that seem unnecessary. There is no need to sort them — the lawyer will go through them on site.

Can I call a lawyer out to an elderly relative?

Yes, but the decisions are made by the person themselves. The presence of close relatives is welcome if he or she has no objection.

Do you travel outside the city?

Yes, within Almaty region up to 50 km. The cost is higher than within the city and is discussed when booking.

Will we sign the documents straight away?

If the content has been agreed in advance — yes, we bring the finished document for signature. Otherwise we prepare it after the meeting.

And if after the visit I decide not to continue?

That is absolutely fine. Only the visit is paid for, and no one will push further support on you.

How much does calling a lawyer to your home cost?

The consultation remains free; only the visit is paid for at the usual rate for the area. There is no surcharge for the client being elderly or having limited mobility.

Can I call a lawyer out to a transaction rather than to my home?

Yes, that is a common reason. The lawyer comes to the buyer's or seller's office, reads the final version of the contract and monitors the payment procedure.

How can I tell that a lawyer is acting in good faith?

You make the first call, the cost is known before the visit, and the contract and receipt stay with you. If the specialist turned up uninvited and is rushing you to sign — that is a reason to refuse.
