Divorced while living in Seoul, without flying in for a single hearing

Situation
The client had been living in Seoul on a work contract for three years, while her husband stayed in Almaty and did not answer messages about the divorce. She could not fly in for hearings: one holiday a year, and the court could postpone at any moment.
What we did
The power of attorney was arranged through the consulate, and the petition for dissolution of marriage was filed together with correspondence showing that the family had effectively broken down two years earlier. The husband did not appear at the first hearing; at the second he came and asked for time for reconciliation — the lawyer objected, presenting evidence of separate residence and no shared household.
Outcome
The court gave one month for reconciliation instead of the possible six, after which the marriage was dissolved. The client never came, and the dissolution documents were collected by power of attorney eleven weeks after the petition was filed.

The husband took their daughter to his parents in Talgar — the child was returned to her mother

Situation

Pregnancy

The husband filed for divorce in the seventh month of his wife's pregnancy

Situation
The petition for dissolution of marriage reached the client when she was in her seventh month. At the same time her husband was trying to re-register their joint car in his mother's name so that it would not be included in the division.
What we did
The lawyer pointed out to the court that without his wife's consent a husband has no right to seek a divorce during her pregnancy and for a year after the child's birth, and attached a medical certificate. At the same time they filed a claim to recognise the car as joint property and an application to prohibit registration actions with it.
Outcome
The court had to return the divorce petition, and the car remained in the spouses' ownership under the prohibition. A year and a half later the marriage was dissolved by agreement: the car went to the client with half its appraised value paid to the husband.

The entrepreneur showed a modest income — maintenance was awarded as a fixed sum

Situation
The husband was an individual entrepreneur under the simplified regime, officially showing around 150,000 tenge of income per month, although the family lived noticeably better off. Maintenance as a share of such earnings would not even have covered kindergarten and extracurricular activities for two children.
What we did
The lawyer gathered evidence of the real level of spending: card statements, office rent and car leasing, and private school invoices that the husband himself had paid. In the divorce claim, maintenance was sought as a fixed sum of money, calculated on the needs of each child.

Situation

What we did

The claim was not for a share in the flat, but for compensation of half of what had been paid during the marriage, with the amount confirmed by a bank statement.

The court awarded the wife 7.25 million tenge in compensation from the husband, payable in instalments over a year. The flat remained his, and the client received the money for a down payment on her own home.

Situation
In the division of property, the husband demanded that a consumer loan of 9 million tenge be recognised as a joint debt and that half of it be set off against the wife's share in the flat. The loan had been taken out during the marriage, and formally this looked convincing.
What we did
The lawyer showed from the statements that the money had gone straight to the account of the husband's LLP — for the purchase of equipment and the rent of a workshop, as confirmed by the company's contracts. The wife had not consented to the loan, and there had been no major family purchases during that period.
Outcome
The court recognised the loan as the husband's personal debt. The flat was divided in half without any set-off, and the client's share was valued at 17 million tenge.

Two years of cross-claims ended in an agreement in a single hearing

Situation
The spouses, with two children and a shared business, had been litigating for a second year: three claims, two expert examinations, and complaints to the police against each other. The children had stopped seeing their father, and the costs of the proceedings were mounting for both sides.
What we did

Can we divorce without going to court?

Yes, if both spouses agree and you have no minor children together. In that case the marriage is dissolved by the civil registry office on a joint application submitted through a Public Service Centre or the portal, one month after submission.

How long does a divorce through court take?

Without a dispute — usually one or two hearings. If the other spouse objects, the court may allow a period for reconciliation of up to six months. Disputes over children and property lengthen the process to several months because of guardianship reports and expert examinations.

Can we divorce without appearing in court?
