Record of service

Four years of work were left out of the record of service because the enterprise was liquidated

Situation
When the pension was awarded, a period of work at a factory liquidated in the nineties was not taken into account. The documents had only been partly transferred to the archive, the stamp in the employment record book for those years was illegible, and the period simply fell out of the calculation — along with it, a noticeable part of the payment.
What we did
We sent requests to the regional archive and to the archive for personnel records, and obtained payroll accounts showing wage accruals for the disputed years. In addition, we found two former colleagues with correct entries in their employment record books for the same period and formalised their testimony.
Outcome
The period was included in the length of service through the court, and the pension was recalculated with an additional payment for the elapsed time. The procedure took five months, four of which were spent waiting for archive responses.
Recalculation

The pension was assigned on incomplete earnings information

Situation
The calculation was made using the data that was in the system, but earnings for several of the most favourable years were not reflected there — the enterprise had submitted the information with errors. The difference in the assigned amount was noticeable, but the person did not know about it: he simply received what had been assigned.
What we did
We retrieved salary certificates for the disputed years, checked them against the data in the system and prepared a calculation of the difference. We filed an application for recalculation, attaching the supporting documents and setting out the grounds for using precisely those periods.
Outcome

The pension was refused because of a disputed period of care

Situation
The woman was refused a pension: she did not have enough length of service, and the period of caring for a child with a disability was not counted because some of the supporting documents had errors in the dates.
What we did
We restored the documentary chain: we obtained duplicate medical reports, certificates confirming the establishment of disability and documents confirming cohabitation and care. We appealed the refusal with a full set of documents.
Outcome

Liquidated enterprise

Nine years of service could not be confirmed: the plant had long been closed

Situation
The man had worked for nine years at a plant that was liquidated in the nineties. The employment record book had survived, but the entries on transfers were certified with the stamp of the workshop rather than the HR department, and some entries had smudged. When the pension was assigned, this period was not included in the length of service — the payment amount turned out to be almost a third lower than expected.
What we did
We sent requests to the state archive and to the archive of the enterprise's legal successor, and obtained payroll accounts showing wage accruals and orders on hiring and dismissal. In addition, we collected information about two colleagues who had worked in the same workshop in the same years and whose periods had already been confirmed.
Outcome
The period was included in the length of service in full, and the pension was recalculated with an additional payment for the elapsed time. The monthly payment increased by 21 thousand tenge.
Employer's contributions

The employer withheld pension contributions but did not transfer them

Situation
The woman had worked at the company for four years, received her salary regularly, and her payslips showed the withholding of mandatory pension contributions. When the savings were checked, it turned out that for two years the contributions had not reached the fund: the employer had withheld them but had not transferred them, and by that time the company had ceased operating.
What we did
We gathered evidence of the employment relationship and actual income: the employment contract, orders, payslips and a bank statement for the salary account. We filed an application for compulsory recovery of the contribution arrears and prepared a claim against the company's former director as the person responsible for the failure to transfer.
Outcome
The contribution arrears for both years were recovered and the savings were credited to the client's account. In addition, a penalty for the late transfer was recovered.
Inheritance of savings

The family did not know that the deceased person's pension savings could be claimed

Situation
After the man's death, his family completed the inheritance of an apartment and a car, but no one thought about the pension savings: the notary did not include them in the list of inherited property, since there was no information about them. More than a year passed and the deadline for accepting the inheritance expired.
What we did
We requested information on the savings and established the amount in the individual account. We prepared documents to include the savings in the estate and an application for the issue of an additional certificate of the right to inheritance, since the main certificate had been issued without taking this asset into account.
Outcome
The savings of 3.1 million tenge were distributed among the heirs. In addition, we arranged the funeral allowance, which the family also did not know about.

The pension was refused because of an error in the documents on length of service

Situation
In the client's employment record book, the surname was written with an error of one letter, while in the archival certificate it was correct. Because of the discrepancy, a six-year period of work was considered not to relate to him, and the payment by length of service was refused.
What we did
We collected documents eliminating the discrepancy: an archival certificate with full personal data, orders on hiring and dismissal, information on the calculation of wages, and documents on the change in the spelling of the surname. We prepared an application to establish the fact of belonging of the documents and submitted the decision to the authorised body.
Outcome
The fact was established, and the period was included in the length of service. The pension was appointed from the date of the initial application, not from the date of the repeat one — the difference was paid in a lump sum.

Situation
The woman had been receiving the payment for many years and had not checked the calculation.
