Construction

Penalty for delay in handing over the facility — 9.4 million tenge

Situation
The client signed a construction contract for a warehouse worth 210 million tenge with a completion date of 30 April 2026. The contractor delayed the facility by four months, citing weather conditions, although the work schedule did not provide for this. The contractor offered to sign the acceptance certificate without comments, although part of the work had not been completed.
What we did
We pulled up the contract and the work production schedule, recorded the actual condition of the facility in a report with the involvement of an independent specialist, and calculated the penalty under the terms of the contract for each day of delay. We sent a claim demanding payment of the penalty and listing the unfinished work before signing the final certificate.
Outcome
The contractor admitted the delay and completed the facility within three weeks; the penalty of 9.4 million tenge was paid without going to court. The final certificate was signed only after the comments were remedied.
Sport

The club failed to pay a bonus to a player — recovered through the Specialized Interdistrict Economic Court

Situation
A professional athlete signed a contract with a club that provided for a bonus of 4.5 million tenge for reaching the final of a tournament. The club achieved the goal but did not pay the bonus, citing an internal bonus regulation that was not attached to the player's contract.
What we did
We studied the employment contract and the federation's regulations, and proved that the club's internal regulation cannot override a term of the individual contract. We prepared a claim, and after refusal — a statement of claim to the Specialized Interdistrict Economic Court with a calculation of the amount and interest for the delay.
Outcome
The Specialized Interdistrict Economic Court granted the claim in full: 4.5 million tenge in bonus and 380 thousand tenge in interest for the delay were recovered. The club paid the amount within two weeks after the decision came into force.
Sea

Cargo damaged during sea carriage — carrier's fault proven

Situation
An importer of equipment received cargo delivered by sea through a port, with damaged packaging on three of twelve places. The freight forwarder claimed that the damage occurred during loading at the port of departure, not through its fault, and refused to compensate 6.1 million tenge in losses.
What we did
We pulled up the bill of lading and the cargo inspection report at the port of arrival, and commissioned an independent examination of the nature of the damage, which established that the packaging had been breached during transportation. We sent a claim to the freight forwarder with a calculation of losses based on the supplier's invoices and attached the expert report.
Outcome
The freight forwarder admitted liability and compensated 6.1 million tenge within a month; the dispute did not reach court. The contract with the freight forwarder was supplemented with a clause on mandatory photo recording of the cargo upon handover.
Tourism

The tour was cancelled two days before departure — full cost refunded

Situation
A family of four paid 2.3 million tenge for a tour, and two days before departure the travel agency announced the cancellation of the flight and offered to postpone it by a month without explaining the reasons and without compensation. The agency cited the tour operator's force majeure but did not provide any documents.
What we did
We requested supporting documents from the agency confirming the cancellation by the tour operator, and established that the force majeure notice had not been sent on time, as required by the contract. We prepared a claim demanding a full refund of the tour cost and compensation for the difference in prices for alternative holidays.
Outcome
The agency refunded the full cost of the tour — 2.3 million tenge — within 10 days, and additionally compensated 180 thousand tenge for the difference in the cost of flights on new dates.
Advertising

Fine for misleading advertising partially challenged

Situation
The company was fined 1.2 million tenge for advertising with the wording "best price in the city", which the authorised body considered misleading, since the comparison was not supported by calculations. The company was prepared to pay the fine in full and to stop the advertising campaign altogether.
What we did
We studied the protocol and the inspection materials and found a procedural violation — the company was not notified of the consideration of the case within the established time limit, which is grounds for reducing the fine. We prepared an appeal against the order with a calculation and evidence of a genuine price comparison for part of the goods.
Outcome
The fine was reduced to 400 thousand tenge, and the part of the advertising campaign with the confirmed comparison was recognised as lawful and continued without changes.
Construction

Defects after handover of the building — developer ordered to remedy them at its own expense

Situation
The owner of an apartment in a new building discovered cracks in the walls and leaks on the balcony four months after signing the acceptance certificate. The developer refused to remedy the defects, citing the fact that the certificate had been signed without comments and that no warranty case had arisen.
What we did
We commissioned a construction and technical expert examination, which confirmed that the defects had arisen due to a violation of construction technology, and not due to the owner's actions. We sent a pre-action claim with the expert report and a demand to remedy the defects within a reasonable time or to reimburse the cost of repairs — 3.7 million tenge.
Outcome
The developer remedied the defects using its own resources within a month and a half, and additionally compensated 250 thousand tenge for the rental of temporary accommodation during the repairs.
Sport

Disqualification overturned after review of the federation's regulations

Situation
The athlete was disqualified for six months for violating the tournament regulations, although, according to his account, there had been no violation — the decision was made on the basis of the protocol without his explanations. The suspension meant the loss of a sponsorship contract for the season.
What we did
We reviewed the federation's regulations and the protocol of the disciplinary commission and established a procedural violation: the athlete was not invited to give explanations before the decision was issued, as required by the regulations. We prepared an appeal to the federation's disciplinary body.
Outcome
The disqualification was overturned, and the athlete was admitted to competitions after three weeks instead of the original six months; the sponsorship contract was preserved.
Tourism

Recovered from the tour operator for a substandard hotel

Situation
The tourist paid 1.6 million tenge for a package with a 5-star hotel, but on arrival received accommodation in a hotel of a lower category without warning, with complaints about the room and meals recorded in photographs on site. The tour operator offered compensation of 50 thousand tenge, which did not cover the difference in price.
What we did
We collected photographic evidence, correspondence with the representative on site and the voucher indicating the original hotel, and calculated the difference in the cost of accommodation according to the tour operator's price list. We sent a pre-action claim demanding a proportionate reduction in the price of the tour.
Outcome
The tour operator paid compensation of 480 thousand tenge — the difference in the cost of accommodation; the dispute was settled without going to court within three weeks.

A charterparty is a contract of affreightment: the shipowner provides a vessel or part of it for carriage on the terms of a voyage. Limitation of liability is possible by agreement of the parties, but does not remove the duty to exercise due care for the goods. The tour operator forms the tourist product: it books transport, accommodation and excursions and is responsible for their actual provision. The travel agent merely promotes and sells the ready-made product on the instructions of the tour operator, and therefore as a general rule is liable for the quality of the service itself only where it is at fault, for example where it provides inaccurate information or changes the terms without agreement.

Advertising of tourism services in Kazakhstan is governed by the Law of the Republic of Kazakhstan on Advertising and further specified by the Law of the Republic of Kazakhstan on Tourism Activity.
