But take it to an embassy, another country's migration service or a foreign bank, and it turns out the translation has to be prepared in a particular way, sometimes with certification of a copy and an apostille. A separate difficulty arises if it is not a Kazakhstan certificate being translated, but a document issued abroad.
Mistakes here are costly: the translation is handed back at the submission stage, an interview appointment is lost, and in the worst case a discrepancy in the spelling of a spouse's surname drags a whole chain of other documents along with it. Below is how a notarised translation of a marriage certificate works, how marriage and divorce cases differ, and what to do about surnames and foreign certificates.
A marriage certificate translation is needed as soon as the marital status recorded in a Kazakh or Russian document has to be confirmed to a foreign recipient: a consulate, a migration service, a bank, a pension authority. After that, the document can be submitted to the migration service, a Public Service Centre, a court or another notary when completing a transaction.
The main difficulty is not the translation itself, but prior legalisation. A foreign marriage certificate requires an apostille or consular legalisation of the country where the marriage was registered — except for documents from the countries of the Minsk (1993) and Chisinau (2002) conventions, which are accepted in Kazakhstan without legalisation. Without this mark, a notarised translation of a marriage certificate will be made, but in substance the document may not be accepted: an officer of the migration service or a court looks at the legalisation, not at the quality of the translation.
Even before ordering a translation, check how the spouses' names and the date of registration are written in the certificate: a discrepancy in even one letter of the surname with the passport leads to the documents being returned. If the marriage certificate was issued in Kazakhstan and needs to be presented abroad, the procedure depends on the country the document is going to. For countries of the Hague Convention, the apostille is placed on the original before translation, and the apostille stamp is also translated: a foreign official must be able to read both the details of the official who issued the certificate and the content of the seal. For countries of the Minsk Convention, an apostille is usually not required — a notarised translation is sufficient there.
The logic is this: first the apostille is placed on the original at the Ministry of Justice or a justice department, then the translator translates both the document itself and that stamp, and a notary certifies the translator's signature. If the translation is done earlier, the apostille stamp will not be included in it and the document will have to be translated again; a separate apostille on an already completed notarised translation is placed only when the receiving country requires it. So it is not worth ordering a translation until it is clear whether the receiving party requires an apostille.
