Soviet birth certificate

Apostille on a 1979 birth certificate for German citizenship

Situation
The client needed her birth certificate with an apostille for German citizenship. The original had been issued in the Kazakh SSR in 1979, handwritten, with a faded village council stamp. The first apostille application was returned: there was nothing against which to verify the official's signature on such a document.
What we did
We ordered a duplicate birth certificate from the civil registry office based on the archival record — a new document with a current signature and stamp. We checked that the mother's surname and patronymic in the archival record matched the client's other documents. We submitted the duplicate certificate for an apostille, then a translator translated it into German together with the stamp, and a notary certified the translator's signature.
Outcome
The package was put together in three weeks, including obtaining the duplicate certificate. The German authority accepted the document without further requests, and the old certificate stayed with the client as a family keepsake.
Criminal record certificate

An apostilled certificate for work in Korea that did not expire in time

Situation
The employer in South Korea required a criminal record certificate with an apostille and translation, issued no earlier than three months before submission. The client had ordered the first certificate himself in advance, but while waiting for the invitation it expired by two weeks, and the consulate refused the documents.
What we did
We worked back from the submission date: when to order a new certificate, when to apply for the apostille, how many days to allow for translation into English and certification. The certificate was ordered through the portal, the apostille and translation were done without pauses between steps, and the translator checked the Latin spelling of the name against the passport.
Outcome
The certificate with the apostille and translation was ready in eight working days and had two and a half months of validity left on the submission date. The visa was issued on the first attempt.

A Russian power of attorney without an apostille for selling a flat in Almaty

Situation
The owner of the flat lives in Novosibirsk and issued a power of attorney to his sister before a Russian notary. The buyer in Almaty, having read about apostilles online, demanded one be affixed, which meant several more weeks of waiting and the risk of losing the deal.
What we did
We checked the power of attorney: Russia and Kazakhstan are parties to the Minsk Convention, and official documents executed by a notary of one country are accepted in the other without an apostille. The lawyer explained the legal basis to the buyer, and no translator was needed — the document was in Russian. We separately checked the representative's authority and the term of the power of attorney.
Outcome
The transaction was certified four days after the client approached us, without an apostille and without the owner having to travel. The buyer received a written explanation of why an apostille was not required in this case.

A degree certificate for a work visa in a country that does not accept apostilles

Situation
An engineer was offered a contract in a country that is not party to the Hague Convention. He had already had an apostille placed on his degree and had it translated, but the employer replied that the apostille was not valid there and consular legalisation was required.
What we did
We checked with the consulate of the destination country what procedure and which certifications were needed for the education document. We prepared a notarised copy of the degree with its transcript, a translation into English, and went through the chain of certifications with the authorised bodies of Kazakhstan and the consulate. The translation already made was reused so that the client would not pay twice.
Outcome
The legalisation took five weeks instead of the three months the employer had expected. The contract was signed, and the start date did not have to be moved.
Double apostille

Marriage certificate for a residence permit in Italy

Situation
The couple were moving to the husband's home in Italy, and a Kazakhstani marriage certificate was required for the residence permit. The wife had obtained the apostille and the translation into Italian from different providers, but the Italian side pointed out that the translation also had to bear an apostille, and that the stamp itself had not been translated in the translation.
What we did
The translation was redone: the translator translated the certificate in full, including the text of the apostille. A notary certified the translator's signature, after which a second apostille was applied to the notarised translation. The spelling of the surnames in Latin script was checked against the passports of both spouses.
Outcome
The package with the double apostille was ready within six working days. The documents were accepted on submission for the residence permit without any comments.

Apostille on a divorce court decision for a client from the USA

Situation
The client had divorced in Almaty six years earlier, and now lives in the USA and was planning to marry again. She was required to provide a Kazakhstani court decision on dissolution of marriage with an apostille. She had not planned to fly in for a single document.
What we did
The client executed a power of attorney before a local notary, it was apostilled in the USA and sent to us as a scan, and then the original by post. A translator translated the power of attorney, and a notary certified the translation. Using the power of attorney, we obtained from the court a copy of the decision with a note that it had entered into legal force, submitted it for an apostille and had it translated into English.
Outcome
The documents were sent by courier four weeks after the power of attorney was received. The marriage in the USA was registered without any further requests.

Situation
The graduate needed her school certificate with an apostille for admission to a Turkish university. At the same time she was applying to a Kazakhstani university, which required the original, and the family did not want to send the only certificate abroad.

Situation
A Kazakhstani company was opening a branch in Tbilisi. The Georgian side requested a registration certificate, the charter and the participant's decision to establish the branch, with an apostille and a translation into English, and the director was flying out for negotiations in ten days.
What we did
We split the work: notarised copies of the charter and the decision, and the registration certificate, in parallel; submission for the apostille as a single package. The translator prepared the translation in advance from scans, and after the apostille was obtained supplemented it with a translation of the stamps. A notary certified the translator's signature.

Or the opposite situation: the paper was issued in another country, and it is required in Almaty for employment, applying for a residence permit or getting married. At first glance it is simple — get the stamp — but this is exactly the stage where people most often lose weeks and money.

Mistakes start small: someone certifies a copy when the apostille is needed on the original, someone translates the document before the apostille and then has to redo the translation. Some take the papers to the wrong authority, or expect the apostille to “work” where full legalisation is required. Below is a workable procedure for the typical situations faced by residents of Almaty.

Apostille and legalisation of documents are two ways to give a paper effect abroad. The apostille is affixed by an authority of the country that issued the document. If the country is not party to the Hague Convention, consular legalisation is required.

If a document was issued in Russia, Ukraine or another country, a Kazakhstan authority will not place an apostille on it: only the issuing state may apostille it. Education documents are the most common category for apostilling after civil registry office certificates. An apostille on a secondary education certificate, a college or university diploma, as well as school references and their supplements, is placed by the authorised body in the field of education: it confirms the signature of the head and the seal of the educational institution. It is important that the form is of the current format, without corrections, blots or traces of lamination — otherwise the apostille will be refused.

An apostille on an education document abroad will be accepted only if two conditions are met. First — the apostille is placed on the document you are submitting: if the receiving party requires an apostille on the original, a notarised copy with an apostille will not replace it, and vice versa. Second — the destination country may require a translation of the document with the apostille into its own language, in which case the translation and apostille of the education certificate are arranged together. It is also worth remembering: an apostille on a certificate does not certify the content, it only legalises the signature and seal, so a university admissions committee is entitled to request additional confirmation.

A notarised translation with an apostille is a sequence of steps that cannot be reordered. First the apostille is placed on the document itself, then the translator produces a written translation including the text of the stamp, after which a notary certifies the authenticity of the translator's signature (the notary certifies the accuracy of the translation themselves only if they speak both languages). Most often what is required abroad are civil registry office certificates: birth, marriage, divorce and death certificates. An apostille on a birth certificate is needed for study, work, a residence permit or marriage abroad; an apostille on a marriage certificate and an apostille on a divorce certificate — to confirm marital status, and an apostille on a death certificate — to arrange an inheritance or a pension. Apostilling a marriage certificate, like other civil status records, is possible only if the document was issued by an authorised body of Kazakhstan and contains all the mandatory details.

If the certificate has been lost or was issued back in Soviet times, a duplicate certificate is first obtained from the civil registry offices at the place where the civil status record is kept or through the eGov portal, and only then is the apostille affixed. The time limit for affixing an apostille is established by the rules for the provision of the state service and does not depend on any additional payment: there is no separate paid "urgent" procedure in Kazakhstan. What can be shortened is the overall time for the package — through a correctly prepared document, a ready translation and submission to the right authority on the first attempt. The promise of an "apostille in 1 day" refers to the preparation of documents, not to the time taken by the state authority.

What speeds up the process: preliminary checking of the document, a correct notarial translation, submission to the right authority and a complete set. If the authority does not have a specimen signature and seal of the official who signed the document, it is sent for additional verification, and the time limit increases. The request "apostille 24" means round-the-clock acceptance of applications, not the affixing of the stamp within 24 hours. Translation and certification by a notary also take time, and this is allowed for separately.

For example, a criminal record certificate with an apostille is usually recognised for several months from the date of issue, while the validity period of an apostille on a birth certificate is effectively equal to the validity period of the document itself — birth and marriage certificates are indefinite, so the apostille on them does not expire either.

What is an apostille and why is it needed?

It is a stamp confirming the authenticity of a signature and seal on an official document so that it is accepted in another country party to the Hague Convention. An apostille does not verify the content of the document. Apostilling documents means the same as affixing an apostille.

Is an apostille needed for Russia and other CIS countries?

For the countries of the Minsk Convention, including Russia and Kyrgyzstan, official documents are usually accepted without an apostille. If an organisation nevertheless asks for one, it is worth first referring to the convention in writing.

Does a notary affix an apostille?

No. An apostille is affixed by an authorised state body. A notary makes notarised copies and certifies a translator's signature, while our practice submits documents for an apostille under a power of attorney.

Can an apostille be affixed to a USSR birth certificate?

Often it cannot: there is nothing against which to verify the signature on an old document. In that case a duplicate certificate is ordered from the civil registry office on the basis of the archival record, and the apostille is affixed to it. Documents issued in Russia or Ukraine — for example, свідоцтво про народження — are apostilled by the body of the issuing country: in Russia an application is submitted through the state services portal or a civil registry office, while in Kazakhstan no apostille is affixed to such documents.

How long is an apostille valid?

The apostille itself is indefinite. But certificates — of no criminal record, of marital status — are usually requested by the receiving party to be recent, issued within a few months before submission.

Does the apostille itself need to be translated?

Yes, the stamp is translated together with the document. That is why the translation is done after the apostille, not before it.

What is a double apostille?

The first apostille is affixed to the original document, the second to its notarised translation. It is required by certain countries, and this is established before work begins.

Can an apostille be arranged without being present in person?

Yes, under a power of attorney. It must expressly state the right to submit and collect documents with an apostille. If you are abroad, the power of attorney is arranged before a consul or a local notary.

How long does an apostille take?

The apostille itself usually takes a few working days; the timeframe is set by the state authority. The full package, including a duplicate certificate, translation and certification, takes longer, so we count the deadlines from the date the document is needed.

Can an apostille be placed on a passport?

On an identity card or passport — no. If needed, an apostille is placed on a notarised copy of the passport.
